Legal entities and management
Linn Maggs Goldwin advises its prospective charitable and not-for-profit clients on the most suitable legal entity for their operations, whether it be as a charitable company, unincorporated charitable trust, charitable company with trading subsidiary or community interest company.
Following the passing of the new Charities Act 2006, a new entity will become available, the Charitable Incorporated Organisation (CIO). This will give charity trustees the opportunity to benefit from a limited liability structure whilst being regulated by one body only, the Charity Commission. The CIO is expected to be come available for use during 2008, but it is still to be finally announced when exactly that will be.
Linn Maggs Goldwin, in association with its specilaist legal partners, also advises on suitable governance structures, including the make-up of Boards of Trustees, membership, management committees, charity registration and constitutions.
